Welcome to The Lost Library (“The Lost Library,” “we,” “us,” or “our”), a trade name of Duron Collective LLC, a Utah limited liability company. These Terms of Use (“Terms”) govern your access to and use of our website at thelostlibrary.co (the “Site”), our in-store services, and any purchases made through either channel (collectively, the “Services”). By browsing our Site, creating an account, placing an order, or visiting our physical store, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Who May Use Our Services
You must be at least 18 years old, or the age of majority in your state, to create an account or make a purchase on our Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian, who agrees to be responsible for your use of the Services.

2. Accounts
If you create an account with us, you agree to:
Provide accurate, current, and complete information;
Keep your login credentials confidential;
Notify us promptly of any unauthorized use of your account; and
Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are used for fraudulent or abusive activity.

3. Products, Pricing, and Availability
Used, overstock, and rare books. Many of our books are used, out-of-print, otherwise pre owned, or overstock. Condition descriptions (e.g., “Good,” “Very Good,” “Like New”) are provided in good faith based on our staff’s assessment, but minor variations in condition (shelf wear, prior owner markings, etc.) should be expected with secondhand inventory.
Pricing. All prices are listed in U.S. dollars and are subject to change without notice. We
make reasonable efforts to ensure pricing accuracy, but errors may occur. If a pricing or listing error is discovered after you’ve placed an order, we will contact you before charging you and give you the option to confirm at the corrected price or cancel your order for a full refund.
Availability. Because our inventory includes single-copy used and rare items, availability is not guaranteed until an order is confirmed. If an item you ordered becomes unavailable (for example, due to a data sync issue between our in-store Square inventory and the Site), we will notify you and issue a refund or offer a comparable substitute at your choice.

4. Orders and Payment
Placing an order through the Site is an offer to purchase, which we may accept or decline (for example, in cases of suspected fraud, pricing errors, or inventory discrepancies).
Payment is processed securely through our point-of-sale and payment provider (Square). We do not store your full payment card information on our servers.
You represent that any payment information you provide is accurate and that you are
authorized to use the payment method provided.

5. Shipping, Pickup, and Returns
Shipping. Estimated delivery times are provided for convenience and are not guaranteed. Risk of loss and title for items pass to you upon our delivery to the shipping carrier.
In-store pickup. If you select in-store pickup, please bring valid ID and your order
confirmation.
Returns and exchanges. Returns are accepted within 30 days of purchase with a receipt, for store credit or exchange. Due to the secondhand nature of our inventory, all sales on clearance or as-is items are final. We recommend spelling this out clearly since return norms differ for used books versus new retail.

6. User Content
If we allow reviews, comments, wish lists, or other user-submitted content on the Site, you agree that:
You will not post anything unlawful, defamatory, obscene, or infringing on another’s rights;
You grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce content you submit in connection with operating and promoting the Services; and We may remove or decline to post any content at our discretion.

7. Intellectual Property
The Site, including its design, text, graphics, logos (including The Lost Library name and logo), and other content we create, is owned by The Lost Library or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. Book cover images, author photos, and publisher-provided descriptions remain the property of their respective rights holders and are used for identification purposes only.

8. Acceptable Use
You agree not to:
Use the Site for any unlawful purpose or in violation of these Terms;
Attempt to gain unauthorized access to our systems, accounts, or inventory data;
Use automated tools (bots, scrapers, crawlers) to access or extract data from the Site
without our written permission; Interfere with or disrupt the Site’s operation or security; or Resell items purchased from us in a manner that falsely implies an affiliation with or endorsement by The Lost Library.

9. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or completely secure, or that book condition descriptions will be perfectly precise for secondhand items.

10. Limitation of Liability
To the fullest extent permitted by law, The Lost Library and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability for any claim relating to the Services or a purchase will not exceed the amount you paid for the item(s) giving rise to the claim. (Some states do not allow certain liability limitations, so some of the above may not apply to you.)

11. Indemnification
You agree to indemnify and hold harmless The Lost Library, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction there. Either party may instead bring an individual claim in small claims court if it qualifies.
(Note: this is the simpler court-based approach rather than mandatory arbitration. If you later want to add a binding arbitration/class-action-waiver clause similar to larger retailers, this section can be replaced — but it’s a more aggressive term that should be reviewed by an attorney given how it affects customers’ rights.)

13. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top will reflect the most recent revision. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
